Special conditions of the offer

These special conditions of sale ("CPV") are supplemented by the general conditions of sale ("GTC") of KineQuantum in their latest versions.

 

All the terms used in the CPV and bearing a capital letter have the meanings attributed to them either in these CPVs or in the KineQuantum GTC.

Article 1. Definitions

 

"Client" refers to any company that carries out the activity of masseur-physiotherapist under the legal form of Individual Entrepreneur, Civil Society of Means (SCM),  of Professional Civil Society (SCP), of Limited Liability Company (SELARL) after express validation by KineQuantum, which purchases a KineQuantum Medical Device.

"Device" means the Software offered by the Client to a third party for therapeutic purposes (the third party being referred to as the "Patient"). This term also designates the brochures, documentation, manuals and update options referenced by KineQuantum SAS in the quote sent to the Customer. This term includes the “Products”, that is to say the hardware, accessories, supplies and computer equipment which accompany the software in the quotation sent to the Customer, when they are supplied with the Software. These materials make it possible in particular to supervise and promote the use of the Software for the Customer. These materials may include products purchased from a third party and whose regulatory compatibility (safety in particular) with the KineQuantum Medical Device has been validated by KineQuantum SAS (“Validated Third Party Products”).

"Installation" means the installation of the KineQuantum Medical Device at the Customer's, within the limits of the services agreed in the quote or the order form.

"KineQuantum SAS" means the company KineQuantum, a simplified joint stock company with a share capital of 4,948.72 Euros, registered with the RCS Créteil under number 814 417 424 00029, whose registered office is located at 5 avenue du Général de Gaulle 94160 Saint- Mandé, France, VAT number: FR85814417424 - Créteil.

Article 2. Conditions of withdrawal

 

For undamaged Devices, from the installation of your Device (Installation Report as proof), the Customer has thirty (30) calendar days to request a return of his Device to KineQuantum SAS, under the following conditions:

  • He  It is up to the Customer to complete the return request attached to these CPV;

  • The Device must be returned in perfect condition:

    • Accompanied by all its accessories;

    • Not showing any lack of maintenance or neglect;

    • Not having undergone any modification, assembly or disassembly operation;

    • Not having undergone any use or intervention not provided for in the user manual;

    • Not having suffered any fall, shock, lightning, fire, force majeure, water damage and / or natural disaster.

 

Subject to the perfect execution of the preceding paragraphs, KineQuantum SAS will confirm to the Customer, after examination of the returned Device, within thirty (30) calendar days following the date of receipt of the Device, the effective taking into account of the Customer's withdrawal.

Article 3. Installation and uninstallation of the Device on site

 

All work necessary and prior to the Installation of the Device will be the responsibility of the Customer and will be undertaken by the latter under his sole responsibility.

 

The Customer is required to give KineQuantum SAS the time and resources required to uninstall the Device on its site.

 

Under no circumstances can KineQuantum SAS be held liable if the Customer wishes to make use of his right of withdrawal as described in article 2 of the CPV, in particular with regard to the work carried out by KineQuantum SAS or its service providers during the Installation of the Device on the Customer's site. KineQuantum SAS cannot therefore be held responsible for modifications that have occurred on the Customer's site following the Installation and uninstallation of the Device.
